ALYSENA™ 28 MULTI-JURISDICTIONAL CLASS ACTION SETTLEMENT
The purpose of this website is for the claims administration of the multi-jurisdictional class action, Kohler v. Laboratorios León Farma SA, Court File Number 1303 13736.
Qualified Class members may submit a claim package concerning Alysena™ 28, a combination oral contraceptive containing levonorgestrel and ethinyl estradiol, which was packaged by Laboratorios León Farma SA (“León Farma”) in Spain and subsequently sold in Canada.
A summary of the proceedings is as follows:
On June 15, 2015, the Court of Queen’s Bench of Alberta (“Alberta Court”) ordered that the class action be certified as a multi-jurisdictional class action on behalf of all women who had been prescribed and had ingested Alysena™ 28 purchased in Canada between November 19, 2012 and April 15, 2013, and the biological fathers of children born to such women after that time period ("Class"). On August 28, 2015, Notice of Multi-Jurisdictional Class Action Certification was given to Class members pursuant to the terms of the Order, and Class members were permitted to opt out of the class action by October 27, 2015 ("Opt Out Period").
Subsequently, the parties entered into a Settlement Agreement to settle the claims of Class members and to expand the Class to include all women who had been prescribed Alesse™ but were instead dispensed and ingested Alysena™ 28 during the same period, and the biological fathers of children who were born to such women. On October 9, 2015, the Alberta Court certified the expanded definition of the Class, extended the opt out Period to November 30, 2015 for all Class members, and allowed Class members who had previously opted out to revoke their opt outs and be given an opportunity to participate in the claims administration process that will be established by the Settlement Agreement approved by the Alberta Court.
The Settlement Agreement was approved on December 1, 2015 at 1:00 p.m., at the Court of Queen's Bench, Law Courts, 1A Sir Winston Churchill Square, Edmonton, Alberta.
